An 8 year old Virginia boy is going to be getting ‘the talk’ from his father a lot sooner than anyone expected. On Christmas day the boy opened up one of his Christmas gifts, a new Nintendo DS, and just like any kid he was excited to start it up and try out his new toy, but he quickly found out there was some surprise free content already loaded onto it, about a dozen pornographic images.

Tom Mayhew, the boys father, purchased the hand held Nintendo video game system at a Virginia area Walmart. There was nothing to indicate that the gaming system was anything but brand new, which makes it even more odd that these pornographic images were left on it.

At first Mayhew thought that Nintendo must have somehow made a mistake. Possibly testing out an app for the DS similar to the one that is already available for Nintendo’s other handheld gaming system, the Wii U. Mayhew now has come to a different conclusion as to how the images ended up his sons DS.

“That it was possibly a bought item at one time and returned, and those thingswere not deleted from it, so it wasn’t a new product. It was a used product.”

 Hopefully for Nintendo and Walmart that this is an isolated incident as they would not want to end up being sued or even fined as a result of this for something such as allowing minors to access pornographic images like Playboy was last year.
