Revenge Porn is a term defined by Urban Dictionary as ‘a nude photograph or video which is publicly shared online (most frequently by an ex-lover of the subject’s) for the purpose of spiteful humiliation and/or the lulz‘. The concept was popularized in recent years by the now defunct website IsAnyoneUp.com and it’s founder, Hunter Moore. Moore released thousands of nude photos of bitter ex lovers from 2009 until 2012 when he shut down the site due to mounting legal concerns and the negative press he received. At one point he even became the target of hacker group Anonymous who were trying to shut down his sites and expose sensitive information on him.

Eventually the act of releasing nude amateur photos and videos offended someone high enough within the US government, and so a new law is being pushed though the California Assembly which could send those who share ‘revenge porn’ photos to jail for 6 months, and a $1000 fine if convicted. Right now, revenge porn is also virtually unstoppable due to a legal loophole protecting the owner of any such website from criminal prosecution, (see Section 230 of the Communications Decency Act of 1996), but that would change with the new bill, provided it could be proved the material was shared ‘with the intent to cause serious emotional distress’. 

 
Holly Jacobs of End Revenge Porn released a statement saying:

“I have made every effort to ensure that it is worded in such a way as to provide the appropriate protection to victims while being careful not to impose on First Amendment rights. If this bill ultimately becomes a law, I am confident and excited about the prospect that other states will follow suit and pass their own bills to outlaw revenge porn.”

End Revenge Porn is an organization that promotes legislation to ban revenge porn and offers resources to people who have been victims of it and has been working with Calif. State Sen. Anthony Canella’s office to tailor the bill to protect victims.
