Earlier this month, ten of thousands of German pornography watchers were slapped with a €250 fine after a Cologne state judge ordered their IP addresses to be released when he confused ‘streaming video’ with ‘downloading files’. The law firm behind the controversial movement, ‘Urmann and Colleagues’ (U+C), targeted the users of the free porn site RedTube.com and issued the letters out.

In the past streaming websites have avoided copyright infringements because there is no copy of the file being made, or traded amongst it’s users, however U+C argues that streaming websites install tiny copies of the file though ‘cookies’ which make the streaming possible, and U+C intends to go after even more possible infringements. Thomas Urmann of U+C spoke out saying, ”Redtube was more like a test balloon.”

Alex Taylor, a representative of RedTube released a statement saying, “RedTube stands by its firm opinion that these letters are completely unfounded and that they violate the rights of those who received it in a very serious manner.”

Meanwhile copyright lawyer Christian Solmecke has said the claims by U+C are unsubstantiated, and the actions of U+C may in fact be illegal. “It is hard to imagine how the IP addresses of the users could have been obtained on a legal basis,” he said to The Guardian.

German media has been reporting that software was used to illegally track 1,000 IP addresses over a 3 hour period, and that a possible email scam could have been created with a false RedTube URL, redirecting users to copyrighted material. One online news source has suggested that no one will fight the fines due to the embarrassment of a court proceedings around online sexual content, and that many people will just pay up, creating one of the most intricate internet scams of the day.
