Revenge Porn Law Banning Publication Passed In California

California Governor Jerry Brown has signed a law which immediately outlaws the online publication of identifiable nude pictures without permission, with the intent to cause emotional distress or humiliation. The penalty is up to six months in jail and a $1,000 fine.

The law comes after a slew of controversy and public out lash at revenge porn sites which are designed to expose, embarrass and discredit ex lovers who have posed nude for videos or photos. this year alone Go Daddy was sued for hosting revenge porn site Texxxan.com, and site owner Hunter Moore, who launched revenge porn website IsAnyoneUp.com in 2010, was targeted by hacker group Anonymous in an attempt to release his private information to the public.

 

The American Civil Liberties Union, an organization advocating individual rights, had opposed the bill, arguing it would restrict free speech rights which has been a concern in other states as well. Florida lawmakers rejected a similar bill earlier this  year after constitutional free speech concerns surfaced there.
